Unilin files infringement action against Windmöller in Düsseldorf, Germany

On September 12, 2018, Unilin filed a court case before the Landgericht Düsseldorf against Windmöller GmbH for infringement of European Patent EP 2 588 311. The infringement action is directed against Windmöller's alleged infringing sales of resilient products, which are amongst others marketed under the brand Wineo Designboden.

The grant of the patent EP 2 588 311, which protects resilient products having a certain reinforcement (e.g. fiberglass) layer, was published by the European Patent Office on May 3, 2017. Windmöller has already filed an opposition against the patent on February 2, 2018, but Unilin is confident that the European Patent Office will confirm the validity of the already granted patent.

In the Düsseldorf court case against Windmöller, Unilin is requesting an injunction preventing Windmöller from further manufacturing and selling such fiberglass resilient products, and damages for past sales. Unilin is expecting a first instance decision within 12 months.

Unilin and its affiliated companies have built a very strong patent portfolio on resilient products over the last years. It currently owns more than 120 granted patents in several countries, covering different aspects of the resilient technologies currently in the market.

Now that the patent authorities have granted additional patents on the different inventions, Unilin shall continue to act against all companies who are making and selling products which are falling under such patents, without a valid license.
